Also heard Mr. R.J. Baruah, learned Additional Public Prosecutor for the State. Page No.# 2/3 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, 1. Sri Rubyson Mayengbam, has prayed for bail in connection with FIR No: Pragjyotishpur P.S Case No. 125/2025 registered under Sections 70(1)/3(5) of BNS. Added Section 74/75 of BNS. 3. TCR as called for has been received. 4. It appears that a charge-sheet has already been submitted in this case as against the present petitioner under Section 61(2) relating to criminal conspiracy and Section 3(5) of BNS, wherefrom, it appears that no role in commission of rape on the victim is attributed to the present petitioner. The statement of the victim recorded by the I.O does not reflect such involvement either. 5. Having regard to the facts of the case, including that the petitioner has already spent 67 days in custody and is a student, the prayer for bail is hereby allowed. 6. Accordingly, the above-named petitioner is allowed to go on bail of Rs.50,000/- (Rupees Fifty Thousand) only with two sureties of like amount subject to the satisfaction of the learned Elaka Magistrate with following conditions: (i) That the petitioner shall regularly appear during the trial, if one commences and shall not try to influence or intimidate the witnesses in any manner; (ii) That the petitioner shall not commit any offence while on bail; Page No.# 3/3 7.
