Mishra, A.P.P. .... 02/25.09.2025 1. The applicant aged about 75 years, who is in custody since 18.06.2025 has approached this Court for grant of regular bail in connection with Kasmar P.S. Case No.39 of 2025, for the offence under Sections 126/ 115(2)/ 109/ 103/ 3 (5) of B.N.S., 2023, pending in the court of learned J.M.1st Class, Bermo at Tenughat. 2. It has been submitted by learned senior counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by the learned senior counsel for the applicant that it is a fight between the family members. The allegation against this applicant is assaulting the female but no injury has been reported. Further, investigation is complete. On above basis prayer for bail has been made. 4. Learned A.P.P. has opposed the prayer for bail of the applicant. 5. Considering the materials available on record and the fact that investigation is complete, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, Bermo at Tenughat in connection with Kasmar P.S. Case No.39 of 2025, subject to the conditions that the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned trial court which he will not change during pendency of this case without prior permission of the court.
