The Court made the following ORDER:
This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A1 and A2, seeking anticipatory bail, in connection with Crime No.209 of 2024 of Kambadur Police Station, Anantapuramu district. 2
2. A case has been registered against the petitioners herein for the offence punishable under Section 108 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 3. Case of the prosecution, in brief, is that the mother of the petitioners namely Yerikala Padmavathamma is the Sarpanch of Kambadur Gram Panchayat and the petitioners herein are alleged to have tortured the deceased for panchayat fund bills, used to induce the deceased to commit suicide and also beat him in the past. On that, the deceased, having vexed with his life, committed suicide by hanging with a rope to fan in Sachivalayam, Kambadur-I on 04.12.2024. Basing on the complaint given by the father of the deceased, the present complaint has been registered. 4. Heard. Perused the record. 5. Learned counsel for the petitioners submitted that, based on the instructions of the District Collector, the District Panchayat Officer issued a show cause notice to the deceased about a month back for the misappropriation took place in Kambadur Gram Panchayat and, on receipt of the said show cause notice, the deceased had taken an extreme step of

committing suicide. He further submitted that by suppressing the said fact, the present complaint has been lodged against the petitioners herein and they are made as scapegoats in the present crime. 6. A perusal of the material on record goes to show that the accusation against the petitioners herein is that they are alleged to have tortured the deceased to release the pending bills. Apart from that, there is no other accusation against the petitioners herein. 7.
In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners herein/A1 and A2 on the following conditions. i) In the event of arrest of the petitioners herein/A1 and A2 in the aforesaid crime, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer. ii) Petitioners shall make themselves available for interrogation by a police officer as and when required, and they shall not, directly or indirectly, make any inducement, threat or

promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. iii) Petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 8. Accordingly, the Criminal Petition is allowed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. _______________________ K.
