2025:HHC:3535 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA Civil Writ Petition No.15075 of 2024 Date of Decision: 25.02.2025 _____________________________________________________________________ Promod Kumar
……...Petitioner Versus Director, Higher Education, Himachal Pradesh …....Respondent Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Rajesh Prakash, Advocate. For the Respondent: Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C. Verma, Additional Advocates General, with Mr. Ravi Chauhan, Deputy Advocate General, for State. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) By way of instant petition, very innocuous prayer has been made to issue directions to respondent to consider his representation dated 01.08.2024 (Annexure P-1), whereby he has made request to transfer him from the present place of posting i.e. Government Senior Secondary School, Sudhar, District Mandi, Himachal Pradesh to a nearby station, as he has already completed normal tenure of posting at present place of his posting.
2. Having regard to the nature of order proposed to be passed coupled with the relief prayed for, there appears to be no justification to call for reply on behalf of respondent, who is otherwise represented by Mr. B.C. Verma, learned Additional Advocate General,
2025:HHC:3535 2 who while accepting notice on behalf of respondent fairly states that representation dated 01.08.2024 (Annexure P-1), if not decided already, shall be decided expeditiously, in accordance with the transfer policy.
3. Consequently, in view of aforesaid fair stand adopted by learned Additional Advocate General, this Court without going into the merits of the case, deems it fit to dispose of the present petition with the direction to respondent to decide the pending representation (Annexure P-1), if not already decided, expeditiously, preferably, within a period of four weeks. Ordered accordingly. Needless to say, authority concerned while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass detailed speaking order taking note of provisions contained in the transfer policy formulated by the Government, wherein admittedly provision has been made to consider cases for transfer on ground of medical condition of the parents. Liberty is reserved to the petitioner to file appropriate proceedings in the appropriate Court of law, if he still remains aggrieved. Pending applications, if any, also stand disposed of.
