JUSTICE PRANJAL DAS ORDER Date : 17.12.2025 1. Heard Mr. A.A.R Karim, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Addl. Public Prosecutor for the State of Assam. 2. This is an application filed u/s 483 of the BNSS, 2023 praying for grant of regular bail to the petitioner namely, Sri. Jahidul Islam who was arrested on Page No.# 2/3 23.06.2025 in connection with Howly P.S Case No. 71/2025 u/s 118(2)/109(1)/351(3)/3(5) of BNS, 2023 and subsequently renumbered as Sessions Case No. 102/2025 at Barpeta, Assam. 3. The allegations contained in the FIR dated 05.06.2025 by the petitioner’s wife is that on 29.04.2025, while she was coming with her minor daughter and mother, the accused No. 1 along with accused No. 2 of the FIR assaulted her with a dao causing head injuries after which she was rescued by the local people. The accused No. 1 of the FIR is the present petitioner being the husband of the informant. 4. The case was charge-sheeted and presently pending as Sessions Case No. 102/2025 before the Ld. Sessions Judge, Barpeta at the stage of trial. 5. The scanned copy of the Case Record has been received, however, the prosecution evidence has not yet started. 6. It is submitted by learned counsel for the petitioner that the informant and the accused being husband and wife have also settled the matter in the meantime. 7. Considering the stage of the case and the length of detention, the above named accused is hereby allowed to go on bail on furnishing a bail bond of Rs. 30,000/- with 1(one) surety of the like amount to the satisfaction of the concerned Ld. Trial Court subject to the conditions that : (i) The petitioner shall be available for the remaining trial. (ii) The petitioner shall not hamper or tamper the evidence. (iii) The petitioner shall not cause any harm or harassment to the informant, who happens to be his own wife. (iv) The petitioner shall not try to influence the witnesses. 8.
