The petitioner has been made accused in connection with Itki P.S. Case No. 82 of 2023, POCSO Case No.170 of 2023, for the offence registered under Section 376 DA of the Indian Penal Code and Sections 6/8/10 POCSO Act and charge has been framed under Sections 376 DA & 506 of the Indian Penal Code and Sections 6/8/10 of POCSO Act, pending in the court of learned Additional Judicial Commissioner-IV-cum-Special Judge, POCSO, Ranchi. Petitioner alongwith co-accused persons have gang raped the victim. Learned counsel for the petitioner has submitted that the statement of the victim has been recorded during trial, in which, in her cross- examination, she has stated that the petitioner had not sexually assaulted her. The victim has supported the prosecution case in her examination-in- chief. It will not be proper at this stage to consider her statement, which has come in her cross-examination. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected.
