Respondent/Complainant Petition under Section 482 of BNSS, 2023(Section 438 of Cr.P.C), is filed praying that in the circumstances stated in the memorandum of grounds filed in support of the Criminal Petition, the High Court may be pleased to enlarge the petitioner on bail in the event of his arrest in connection with FIR. No. 487 of 2022, dated 23.12.2022 on the file of Alipiri Police Station, Tirupati District. The petition coming on for hearing, upon perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the
arguments of Sri CH VENKAT RAMAN, Advocate for the Petitioner and of PUBLIC PROSECUTOR for Respondent, the Court made the following.

ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity [the BNSS') by the petitioner/Accused No.5for granting of pre-arrest bail in connection I with Crime No|487of 2022 of AIipiri Police Station, Tirupati District, registered for the alleged offences punishable under Sections 420, 406, 467, 468, 471, 474 and 506 read with 34 of the Indian Penal Code,1860 (for brevity fthelPC').
2. The case of the prosecution is that on 23.12.2022 at about 06.00, a report lodged by the complainant and stated that Accused No.1 had created a forged death certificate of P. Thurupalamma and registered her house sites by selling them to Accused No.2 with the support of Accused No.3 and Accused No.4, and cheated the complainant by creating forged documents in Survey Nos.77/5 and 77/9, in FIat No.172/A and 172/B, to an extent of 2160 square feet, fraudulently and with common intention, and took possession of the same. Later, Accused Nos.1 to 4 colluded JffianCiJ sold the above property to Accused No.5 v,-de Document No.5467/2022, dated 07.10.2022, and handed over possession to Accused No 5 Thuii A;6£ed Nos 1 to 5 colluded with

When the complaI'nant questioned them, all the accused threatened her with dire consequences. Based on the report of the complainant, a case was registered against the petitioner/Accused No.5.

Sri CH.Venkat Raman, the learned counsel for the petitioner, submits that the petitioner has not committed any offence; he was falsely implicated in this case,I he is the sole breadwinner of his family; he is ready to abide any conditions to be|''imposed by this court; and urged to grant pre-arrest bail to the petitioner/Accused No.5.
4. Per confra, Ms. P.Akila Naidu, the learned Assistant Public Prosecutor, opposed in granting of bail stating that investigation is not yet completed; if the petitioner was granted pre-arrest bail, he will repeat the same offence and urged to dismiss the bail petition.

6. As seen from the record, the allegation is that Accused No.2 forged the signature of the deceased and sold the property to Accused No.1. Later, Accused No.1 sold the property to Accused No.5. The

Dr. YLR, J crI.P.No.7277 of 2O25 gft Dated 21.07.2025 No.5 is a bona tide purchaser from Accused No.1. The FIR registered in the year 2022 shows the petitioner as one of the accused. The petitioner is a native of Bangalore, and he has got fixed abode. , The dispute in between the petitioner/Accused No.5 and the_ de-facto complainant pr,-ma fac,'e appears to be civil in nature.
7. ln view of the nature of the allegations leveled against the petitioner/Accused No.5, his alleged.-. role in this case, the nature of the transaction conspired between Accused Nos.1 and 5, and the fact that the petitioner has a fixed abode, this Court deems i{ fit to grant pre-arrest bail to the petitioner/Accused No.5.
8. [n the result, the Criminal Petition is allowed with the following conditions: i. In the event of his arrest, the petitioner/Accused No.5 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only),with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The petitioner/Accused No.5 shall make himself available for investigation as and when 7equired; €=-`-.'_ `

The petitioner/Accused''No.5 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The petitioner/Accused No.5 shall not leave the district liml-ts without the express permission from the Station House Officer concerned.
