JUSTICE PRAMIL KUMAR MATHUR Order 25/07/2025 1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.1/2025 registered at Police Station- Cyber Police Thana, District-Bhiwadi for the offences under Section 66D of IT Act and Sections 317(2), 317(4), 317(5), 318(2), 318(4), 319(2) and 61(2) of BNS. [2025:RJ-JP:28078] (2 of 3) [CRLMB-9231/2025] 2. Since both the bail applications have arisen from common order, hence, they are being decided by this single order. 3. Heard learned counsel for the petitioner, learned Public Prosecutor and counsel for the complainant and perused the material available on record. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. The charges alleged against the petitioners are that they have not returned the outstanding amount paid by the complainant. He submits that the petitioners have amicably settled their dispute with the complainant and have paid the amount to the complainant. In support of their contention they have filed the compromise deed dated 03.07.2025 according to which a compromise has been entered between complainant and the petitioners with respect to the alleged offence. Petitioners are behind the bars since their date of arrest and the cases are triable by Magistrate. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 5. Learned counsel appearing for the complainant has submitted that it is not disputed that the compromise has been arrived between both the parties and both the parties have amicably settled their dispute. 6. Learned Public Prosecutor has vehemently opposed the bail applications. 7. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the [2025:RJ-JP:28078] (3 of 3) [CRLMB-9231/2025] case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 8. Accordingly, the bail applications under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Imran Khan S/o Jafar Mohammad and Imran Ali @ Vikas Saini S/o Anwar Ali @ Ramesh Saini shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
