JUSTICE RAJESH MAZUMDAR ORDER Date : 16-12-2025 By the order dated 11.12.2025, this case was directed to be listed again on the 1st of March 2026, on which date the learned Addl. P.P was required to place the report of the Superintendent of Police before this Court. This Court has noticed that 1st of March 2026 is a non-working day and therefore this matter was Page No.# 2/3 directed to be listed today in the column to be spoken to. The learned counsels appearing for the petitioner and the learned Addl. P.P are present and the following orders are passed. The last three paragraphs of the order dated 11-12- 2025 which read as : “In view of the above, this Court directs that the Superintendent of Police Dibrugarh, to immediately call for the certified copies of the charge-sheet submitted before the Trial Court and cause an enquiry as to whether such manipulation had in fact taken place and if such manipulation were effected in records which has been submitted to the Court, appropriate actions be initiated and the same be brought to their logical conclusion within a period of 2(two) months from the date of this order. Although the prayer for bail application is allowed, the case be listed again on 01.03.2026 on which date, the learned Addl. P.P shall place the report of the Superintendent of Police before this Court. It is made clear that the Superintendent of Police shall ensure that the process of investigation into the manipulation of the date is completed prior to that date. A copy of this order be given to Mr. K.K Parasar, learned Addl. P.P to enable him to take proper steps for doing needful.” shall be substituted by the following paragraphs: “In view of the above, this Court directs that the Superintendent of Police to immediately call for the certified copies of the charge sheet submitted before the Trial Court and cause an enquiry as to whether such manipulation had in fact taken place and if such manipulation were effected in the records which had been submitted to the Court, appropriate action would be initiated and the same be brought to the logical conclusion within a period of two months from the date of this order. Page No.# 3/3 On completion of the enquiry directed to be conducted by the Superintendent of Police Dibrugarh, the report of the said enquiry shall be placed before the learned Additional Sessions Judge, Dibrugarh. It is made clear that the Superintendent of Police shall ensure the process of investigation into the manipulation of the date is completed prior to 2nd of March 2026 and the report of the enquiry is placed before the Court of the learned Additional Sessions Judge on 9th of March 2026. A copy of this order be transmitted to the learned Trial Court to be retained in the records of Sessions Case No. 245 of 2024 pending in the Court of the learned Additional Sessions Judge, Dibrugarh. Accordingly, this bail petition is disposed of. This order be read in continuation of the order dated 11.12.2025 passed in BA No 3994/2025. JUDGE Comparing Assistant
