[2025:RJ-JP:30794] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 9152/2025 Arfina W/o Marhoom Noormohammad, Aged About 35 Years, R/o Nimka, Police Station Bicchor, District Nunh, Haryana, Presently Bhandara, Police Station Jurhara, District Deeg, Rajasthan. (At Present Confined In District Jail Deeg). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vikram Singh Chauhan For Respondent(s) : Mr. N.S. Dhakar, PP Mr. Pallav Choudhary, for complainant HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 07/08/2025
1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.431/2024 registered at Police Station Kaman, District Deeg for the offences punishable under Sections 189(2), 103(2) and 307 of the Bharatiya Nyaya Sanhita, (in short ‘BNS’) 2023. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that bare perusal of the FIR would reveal that petitioner is wife of the deceased. It is submitted that charge- sheet has been filed for offences punishable under Sections 307, 115(2), 126(2), 108 & 3(5) of BNS, 2023. It is contended that trial will take considerable time in its conclusion. Counsel contends
[2025:RJ-JP:30794] (2 of 3) [CRLMB-9152/2025] that petitioner is in custody since her date of arrest and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by counsel for the petitioner. It is submitted that matter has not been investigated fairly by the Investigating Agency and without any evidence, offence of murder has been converted into abetment of suicide. It is submitted that statement of the deceased would reveal that petitioner has also actively participated in commission of crime. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially considering the material available on record in the form of charge-sheet, as also considering the role attributed to the petitioner and trial will take considerable time in its conclusion as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow this bail application. 6.
6. This bail application is accordingly allowed and it is directed that
accused-petitioner

The observations made hereinabove are only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J CHARU SONI /247
