JUSTICE PRAVEER BHATNAGAR Order 28/08/2025 1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.76/2025 registered at [2025:RJ-JP:34385] (2 of 3) [CRLMB-9202/2025] Police Station Ranpur, District Kota City for the offence(s) under Sections 318(4) and 316(4) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the charge-sheet against the petitioner has already been submitted. The main allegation of siphoning off the approximately amount of Rs. 22,00,000/- is against other co- accused Harish Maheshwari which was accounted in the account of complainant and he thereby deceived the complainant by transferring the said amount in the various accounts. It is also contended that the petitioners are not involved in committing any cyber fraud. The said amount was transferred in the account of petitioner at the instance of Harish Maheshwari and the amount was transferred back to Harish Maheshwari. The investigation also revealed that the petitioner Bhupendra Meena has transferred the majority of amount into the account of Harish Maheshwari and his wife Reena Maheshwari through Phone Pay. The petitioners are in custody since long and trial of the case may take considerable time and there are no criminal antecedents against the petitioner, therefore, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed these bail applications. 4. Heard and perused the material available on record. 5. Considering the fact that the charge-sheet against the petitioners have already been submitted. The matter is exclusively triable by Magistrate and the main allegations of causing cyber fraud with the company and transferring the amount in the [2025:RJ-JP:34385] (3 of 3) [CRLMB-9202/2025] petitioner's account are against the other co-accused Harish Maheshwari, therefore, considering the above facts, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: 1. Pappu S/o Late Madanlal and 2. Bhupendra Meena S/o Suresh Kumar, in connection with FIR No.76/2025 registered at Police Station Ranpur, District Kota City, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
