Keeping in view the averments made in the application under Section 5 of Limitation Act, duly supported by affidavit, we are of the opinion that sufficient cause has been made out to condone the delay in filing the appeal. Therefore, delay of 189 days in filing the appeal is condoned. 3. Application stands disposed of. LPA Filing No. 43170 of 2024 4. Appeal be registered. 5. Issue notice to the respondent, returnable by the next date of hearing. 6. Inter alia contends that as per the writ petition the construction of the road namely Jabal- Jai Nagar-via- Manlogkalan, Tehsil Ramshehar, District Solan was done in the year 1982. The first notice was served only on 24.06.2017, (Annexure P-2), which fact has been discounted by the learned Single Judge regarding the delay of 38 years as there was no objection by the predecessor. 7. It is thus submitted that a similar issue is pending in LPA No.337 of 2025, titled State of H.P. & anr. versus Punit Bashtu a/w connected matters, which is listed on 14.10.2025. 8. Accordingly, the present appeal be listed to be heard with LPA No.337 of 2025 on 14.10.2025. CMP No. 1967 of 2024 9. Notice in the aforesaid terms. 10. Operation of judgment passed by learned Single Judge in CWP No.1962 of 2018, tiled as Deep Ram versus State of Himachal Pradesh and others, decided on 22.03.2024, shall remain stayed, till the next date of hearing. 11.
