In a suit instituted by the plaintiff, an application for grant of temporary injunction was moved on 23.10.2015 which is pending consideration. Learned counsel for the petitioner submits that the defendant- respondents had filed an application under Order VII Rule 11 CPC on 17.12.2015 and the same is still pending consideration. According to him, the Court concerned is only hearing the application under Order VII Rule 11 CPC and not proceeding to decide the application for grant of temporary injunction. As it is well settled that the application under Order VII Rule 11 CPC has to be decided first, the Court concerned is hereby directed to proceed with the matter and decide the application filed under Order VII Rule 11 CPC after hearing all the concerned parties, strictly in accordance with law, preferably within a period of four months from the date of production of certified copy of this order. In case, the said application under Order VII Rule 11 CPC is rejected, then the Court concerned shall proceed to decide the application for grant of temporary injunction dated 23.10.2015 within next two months.
