This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 323, 494, 498A, 504, 506, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act in connection with Nimdih PS Case No. 34 of 2023 pending in the Court of Additional Chief Judicial Magistrate, Chandil. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The petitioner is the husband. There is allegation against this petitioner that he tortured his wife and demanded dowry. During course of the argument it has been submitted by the informant that now chargesheet has already been submitted against the petitioner and he is not an absconder. Submission 2025:JHHC:13014 2 of chargesheet clearly suggests that during investigation it was not felt by the authorities to arrest the petitioner. When there is no necessity to arrest the petitioner during investigation, this Court fails to understand why he should not appear before the Court concerned. 5. Accordingly, this Anticipatory Bail Application stands disposed of with a direction to the petitioner to appear before the Court concerned and take necessary steps. (ANANDA SEN, J.) Tanuj/Cp-3
