02/ 09.09.2025: Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant.
2. The petitioner is apprehending his arrest in connection with Manjhiaon P.S. Case No. 97 of 2025, registered under sections 85, 80, 61(2) of BNS, pending in the Court of learned Additional Chief Judicial Magistrate, Garhwa.

Learned counsel for the petitioner submits that petitioner happens to be uncle-in-law of the deceased and husband of the deceased is in custody. He submits that case has been registered under sections 85, 80, 61 (2) of BNS, 2023. He submits that merely on suspicion the petitioner has been implicated in this case. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsels for the State and informant oppose the prayer and submit that allegations are there against all the accused persons of administering poison upon the deceased.

Considering that petitioner happens to be uncle-in-law of the deceased and husband of the deceased is in custody and looking into F.I.R, it does not transpire that how this petitioner instigated the deceased to take such step, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Garhwa, in connection with Manjhiaon P.S. Case No. 97 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
