[ 2025:JHHC:28986] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 8769 of 2025 Aakash Kumar @ Akash Kumar @ Aakash Ram @ Akash Ram @Akash Kumar Ram, aged about 31 years, son of Suraj Kumar Ram, resident of Belwatika, Ward No:15, Medni Nagar, P.O.- Belwatika, P.S. Medni Nagar, District- Palamau … Petitioner Versus The State of Jharkhand … Opp. party Coram: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY For the Petitioner : Mr. Vikesh Kumar ,Adv. For the State : Mr. Praful Jojo , Addl. PP. 02 / 19.09.2025 Heard the parties. The petitioner has been made accused in connection with Daltonganj Sadar P. S. case no. 0004 of 2024 (S.T. No. 225 of 2025) instituted under Section 111(2) (b ), 308 (4) 308 (5), and 109 (1) of BNS, 2023 read with Section 27 of the Arms Act. Learned counsel appearing for the petitioner submits that this is the second journey of the petitioner with the prayer for regular bail and the prayer for regular bail of the petitioner was earlier rejected on merit vide order dated 09.05.2025 passed in B.A. No. 3775 of 2025 and the only fresh ground is that the charge has already been framed but no witness has been examined as yet and the petitioner has remained in judicial custody for an additional period of more than three months since the rejection of his earlier prayer of bail. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co-operate with the trial of the case hence, the petitioner may be admitted to regular bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that petitioner is involved in the gang of extortionists committing organized crime, hence, he is a threat to the law and order situation in the locality and there is every chance of the petitioner absconding, if released on bail and also there is chance of the petitioner tampering with the evidence. It is therefore submitted that the petitioner ought not be released on bail at this stage. Considering the serious nature of allegation against the petitioner and the fact that, he is a threat to the law and order situation in the locality as well as the chance of his absconding, if released on bail, this Court is of the considered view that the prayer of regular bail of the petitioner is again rejected for the same reasons as mentioned in the order dated 09.05.2025 passed in B.A. No. 3775 of 2025.
