The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the order dated 9.2.2024 passed by Judicial Magistrate, Jewar, Gautam Buddha Nagar in case arising out of case crime No. 336 of 2023, Police Station Rabupura, District Gautam Buddha Nagar, whereby an application under Section 155(2), Cr.P.C. has been dismissed. Learned counsel for the applicant fairly admits that the F.I.R. was lodged under Sections 323, 504, 506, I.P.C. and charge sheet has been submitted in the present case. After some arguments, learned counsel for the applicant does not want to press this application and the same may be dismissed as not pressed. The instant application is dismissed as not pressed accordingly. Office shall return the certified copy of the order to the learned counsel for the applicant, after retaining a xerox of the same.
