The petitioner is apprehending his arrest in connection with Herhanj PS Case No.03 of 2025, for offence registered under section 17 and 18 of Narcotic Drugs and Psychotropic Substances Act, pending in court of learned Sessions Judge cum Special Judge, NDPS, at Latehar.

Learned counsel for petitioner submits that false allegations are made out of cultivation of poppy plants in the forest area. She submits that petitioner has got no criminal antecedent as disclosed in para 16 and even the land of the petitioner has been denied and the said land is of the forest department and the coaccused has been granted anticipatory bail in ABA No.4087 of 2025.
4. Learned State counsel opposes prayer and submits that allegations are made of cultivation of poppy plants.

Considering that petitioner has got no criminal antecedent as disclosed in para 16 and even the land of the petitioner has been denied and the said land is of the forest department and the coaccused has been granted anticipatory bail in ABA No.4087 of 2025, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sessions Judge cum Special Judge, NDPS, at Latehar, in connection with Herhanj PS Case No.03 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
