Junior Civil Judge, Chilakaluripet, as arbitrary, illegal and in violation of the Petitioners fundamental rights, and consequently direct the 3rd Respondent to cause registration of the FIR through a competent and impartial Investigating Officer not below the rank of Inspector of Police, preferably from a different police station and further direct the 2nd Respondent to initiate appropriate disciplinary proceedings against the 4th Respondent for willful disobedience of a judicial order and pass such IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the 3rd Respondent - Superintendent of Police, Palnadu District - to forthwith take necessary steps to cause registration of an FIR based on the complaint of the Petitioner pursuant to the order dated 12.02.2025 in CFR No. 2207/2024 passed by the I Addl. Junior Civil Judge, Chilakaluripet, and appoint a competent police officer, not below the rank of Inspector, to take up the investigation, pending disposal of the writ petition: and pass such Counsel for the Petitioner:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“….to issue a Writ, more particularly one in the nature of a Writ of Mandamus, declaring the inaction of the 4th Respondent in failing to register the FIR pursuant to the order dated 12.02.2025 in CFR No. 2207/2024 passed by the I Addl. Junior Civil Judge, Chilakaluripet, as arbitrary, illegal and in violation of the Petitioners fundamental rights, and consequently direct the 3rd Respondent to cause registration of the FIR through a competent and impartial Investigating Officer not below the rank of Inspector of Police, preferably from a different police station and further direct the 2nd Respondent to initiate appropriate disciplinary proceedings against the 4th Respondent for willful disobedience of a judicial order and pass such.…”
2. Heard Ms.Turaga MK Praneetha, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home.

Learned counsel for the petitioner would submit that though there is an
order dated 12.02.2025 passed by the learned I Additional Junior Civil Judge, Chilakaluripet, with a direction to the police to register the FIR, the police have not register the FIR.
4. Learned Assistant Government Pleader would submit that the police have registered the crime in Crime No.211 of 2025, under Sections 322, 325, 503, 508 r/w 34 IPC and 156(3) Cr.P.C of Chilakaluripet Town Police Station, pursuant to the order dated 12.02.2025.

Learned counsel for the petitioner would submit that recording the same, this writ petition may be disposed of.

6. Recording the submission of learned Assistant Government Pleader, this Writ Petition is disposed of. There shall be no order as to costs.
