1. Mr. F.U. Barbhuiya, learned counsel for the petitioner and Mr. A.K. Ghosh,
learned counsel appearing on behalf of Mr. S. Dutta, learned counsel for the respondent no.1 submit that the order dated 02.02.2024 passed in WP(C) 359/2023 has been complied with, except for the actual payment of minimum scale of pay.
2. The letter no. eCF No.618424/43 dated 27.11.2025 issued by the Under Secretary to the Government of Assam, P&RD Department states as follows :

“Sub: Regarding Contempt Case (C)No.10/2025 A S M Mashud Laskar Vs- Dr. J.B. Ekka. Ref: This Department's earlier letter No. 1/1228913/2025 dated 30.08.2025. Sir, In continuation of this Department's earlier communications vide letter under reference on the matter of Contempt Case (C)No.10/2025 ASM Mashud Laskar Vs- Dr. J.B. Ekka, I am directed to inform you that in response to this Department's letter Nos. E-273027/82 dated 01-04-2025 and E-273027/83 dated 27-05-2025, O/o the Commissioner, P&RD, Assam has submitted a detailed report vide their letter No.CPRD/LC/33/2023/89 dated 03.11.2025 (copy enclosed). I am also directed to inform you that Finance Department vide No.FEC(II) 187962/511-A dated 14.11.2025 has approved the name of the petitioner A S M Mashud Laskar amongst 840 nos, of Casual workers for grant of minimum of pay scale. In view of the above, the Hon'ble Court may kindly be apprised of the above mentioned facts so that the contempt proceedings against the Contemnor No.1 be dropped accordingly. This is four favour of your kind information and necessary action.”
3. Mr. A.K. Ghosh submits that as per instructions received, the minimum scale of pay would be paid to the petitioner, within 4 (four) months from today.
4. In view of the letter dated 27.11.2025 and the submission made on behalf of Mr. S. Dutta that the payment of minimum scale of pay would be paid to the petitioner, within 4 (four) months from today, the contempt petition stands closed.
5. The letter no. eCF No.618424/43 dated 27.11.2025 issued by the Under Secretary to the Government of Assam, P&RD Department is made a part of the record and marked as Annexure-X.
