JUSTICE SANJEEV KUMAR SHARMA ORDER 04.12.2025 1. Heard Mr. M.H. Ahmed, learned counsel for the petitioner. Also heard Ms. S.H. Bora, learned Additional Public Prosecutor for the State. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Jakir Hussain, has prayed for grant of bail in connection with G.R Case No. 903/2025 arising out of Laluk P.S Case No.198/2025, registered under Sections 74/75(2) of BNS, 2023, pending before the learned SDJM(S), Lakhimpur. 3. The allegation as reflected in the FIR is that on 02.10.2025, at about 6 PM, while the informant was returning home from a nearby shop, the petitioner and one Pankaj Das wrongfully restrained her on the way and made obscene gestures and remarks. It is further alleged that one of the accused persons attempted to pull down her wearing apparel and that the accused touched her breast with ill intention, after which she managed to escape from the place of occurrence. 4. The charge-sheet in the case has already been submitted and the petitioner has behind the bars for the last 61 days. 5. Having regard to the nature of the allegations, period of detention and the fact that the investigation has been completed, Page No.# 3/3 the prayer for bail is allowed. 6. Accordingly, the above named petitioner shall be released on bail of Rs. 50,000/-(Rupees Fifty Thousand) only with 1(one) surety of the like amount to the satisfaction of the concerned learned Court. 7. It is further provided that the petitioner : i) shall participate regularly in the trial and shall not try to intimidate the witnesses; ii) shall not abscond; iii) shall not hamper or tamper the investigation or with the evidence. 8.
