The instant application has been filed for quashing the interim maintenance order dated 23.11.2023 passed by ACMM-III, Kanpur Nagar, under Section 23 of Domestic Violence Act in Complaint Case No.528 of 2022, under Section 12 of Protection of Women from Domestic Violence Act, 2005, Police Station- Bidhnoo, District Kanpur Nagar including the recovery order dated 14.02.2024 passed by A.C.M.M.-III, Kanpur Nagar. 3. Learned AGA has raised a preliminary objection that the impugned order is appealable under Section 29 of the Domestic Violence Act. 4. At this stage, learned counsel for the applicant submits that he may be permitted to withdraw the present application with liberty to avail the remedy of appeal under Section 29 of the Domestic Violence Act. 5. In view of above, the present application is dismissed as withdrawn with the aforesaid liberty. 6.
