(2) Petitioner was appointed as Junior Engineer in Ganna Anusandhan Kendra in Kashipur, which was a unit of U.P. Council of Sugarcane Research. Upon State reorganisation, the said Ganna Anusandhan Kendra was handed over to G.B. Pant University. Petitioner submits that he was subsequently promoted as Assistant Engineer on 17.2.2014. In this writ petition, petitioner has sought a direction to the authorities to reckon his seniority on the post of Assistant Engineer with effect from the date he became eligible for such promotion. (3) No provision, statutory rule or executive instructions has been produced by the petitioner for claiming such relief. Law is well settled that status of a person is altered only upon his substantive promotion to next higher post. Since petitioner was serving as Junior Engineer till his promotion as Assistant Engineer in 2014, therefore, the claim staked by the petitioner for giving status of Assistant Engineer from the date he became eligible for promotion to the said post cannot be granted.
