Sarla Devi (deceased) through LRs vs. Seema Devi and Another CMP No. 23051 of 2025 22.09.2025 Present: Mr. Naresh Sharma, Advocate for the appellants/applicants. Heard learned counsel for the appellants and perused the application. The appeal in the case at hand was decided by the First Appellate Court on 08.05.2025. The sole appellant, i.e., predecessor-in-interest of the present applicants had thereafter died on 11.06.2025, the fact of death is evident from the death certificate appended along with the present application. The right to sue survives with the present applicants, as they are the legal representatives of the deceased Sarla Devi. The details of legal heirs, as mentioned in para No. 3 of the application are in consonance with the legal heir certificate appended along with the present application. In view thereof, the present application is allowed. The applicants are permitted to pursue the present appeal being legal heirs of Sarla Devi, who was the sole appellant before the First Appellate Court. Application stands disposed of.
