BEFORE HONOURABLE MR. JUSTICE KARDAK ETE ORDER Date : 05-12-2025 Heard Mr. N. N. B. Choudhury, learned counsel for the petitioners. Also heard Ms. B. Musahary, learned Standing Counsel, Secondary Education for the respondents. Mr. Choudhury, learned counsel by placing the order dated 19.11.2025 passed by the Division Bench of this Court in Writ Appeal No. 273/2025, whereby, a similar issue involving same facts and law, in which the learned Single Judge had dismissed the writ petition, has been upheld by dismissing the appeal of the similarly situated petitioner, fairly submits that in view of the order of the Division Bench, the issue may no longer be survived for consideration by this Court. Considering that a similar matter has been considered and disposed of by the Division Bench vide order dated 19.11.2025, whereby the grievance of the same nature in this proceedings, which was dismissed by the Coordinate Bench, has been upheld, it would not be permissible to consider the issue which has already been settled by the Division Bench. Accordingly, the writ petition is closed and disposed of.
