BEFORE HONOURABLE MRS. JUSTICE YARENJUNGLA LONGKUMER ORDER Date : 11.12.2025 The learned counsel Mr. R. Goswami is present for the appellant and Mr. M. Islam, learned counsel is present for the respondent Nos. 1 to 3. This matter has been preferred to the Gauhati High Court Mediation Centre by order dated 31.07.2025. The report of the mediator has been received vide 04.12.2025 wherein it is stated that mediation proceeding were held on 08.08.2025, 27.08.2025, 28.08.2025, 09.10.2025, 28.10.2025, 19.11.2025 and 04.12.2025 and thereafter, the parties have decided to settle the matter as per the terms and conditions of the agreement signed by them. The mediation agreement entered into between the parties dated 04.12.2025 is on record. As per the mediation agreement, the parties have mutually agreed for compensation for one time amount of Rs.13,40,000/-(Rupees Thirteen Lakhs forty thousand). Further the appellant agreed to pay the
Page No.# 3/3 same amount within 4(four) weeks. It is further agreed that the amount of Rs.13,40,000/-(Rupees Thirteen Lakhs forty thousand) will be paid at once but not in installments by the appellant to the respondents by cheque in the respondent’s bank account No.31202466416 SBI Dhalgaon in the name of Sufia Khatun. IFSC No.SBIN0005049 MICR 784002501. It has also been agreed between the parties not to lodge any further litigation in future regarding the same case.
Accordingly, this appeal is disposed of in terms of the mediation agreement dated 04.12.2025. It is directed that the appellant shall deposit the settled amount of Rs. Rs.13,40,000/-(Rupees Thirteen Lakhs forty thousand) in the account of the respondent/claimant within 4(four) weeks from today. The mediation agreement dated 04.12.2025 shall also form part of the record. JUDGE Comparing Assistant
