Heard Ms. Pratibha Sahu holding brief of Mr. Rajkumar Pali, learned counsel for the petitioners. Also heard Mr. Hariom Rai, learned Panel Lawyer, appearing for the State/respondent No.1 and Mr. Amit Buxy, learned counsel, appearing for respondent No.2. 2. The present petition has been filed by the petitioners under Section 482 of the Code of Criminal Procedure, 1973 with following prayers :- “It is therefore, prayed that the Hon'ble Court may kindly be pleased to allow this petition and quash the charge sheet (Final report) and further be please to quash the criminal proceeding which is pending before the learned Judicial Magistrate First Class, Raipur (C.G.) in Criminal Case No.8172/2019 and acquit them from the above mentioned charges, in the interest of justice.” 3. There appears to be no interim order passed in the present case and learned counsel, appearing for respondent No.2 has submitted that the case is fixed for prosecution evidence. 4. Considering the fact that the matter is pending since 2023 and no interim order has been passed and at this belated stage, we do not deem it proper to adjudicate the present case. 3 5. Accordingly, the instant petition is dismissed leaving it open to the petitioners that if the evidence has not yet been started, they may take recourse to law if any charges have been framed against them.
