2. This is an application under Section 483 of the BNSS, 2023 praying for grant of bail to the petitioner Sri Bijoyan Das, who has been in custody in respect of POCSO Case No. 11/2025 arising out of Majuli P.S. Case No. 11/2025 pending in the Court of the learned Special Judge (POCSO), Majuli.
3. Mr. Kachari has submitted that he has no objection if the petitioner is allowed to go on bail. Mr. Kachari has further submitted that he took this stand in the trial court also.
4. I have considered the submissions made by the learned counsel of both sides.
5. Considering the submission made by the learned counsel of both sides, this Court is of the opinion that under the given circumstances, the petitioner no longer deserves to be detained in custody.
6. Therefore, the bail application of the petitioner is allowed.
7. It is hereby directed that the petitioner Sri Bijoyan Das, who was arrested in respect of POCSO Case No. 11/2025 arising out of Majuli P.S. Case No. 11/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of learned Special Judge (POCSO), Majuli. With the aforesaid direction, the bail application stands disposed of accordingly. JUDGE Comparing Assistant
