ORDER
The case is taken up before the National Lok Adalat.
The Oriental Insurance Company Limited, is represented by its duly authorized officials, namely, Mr. R. K. K. Sinha, Regional Manager, and R. C. Pathak, Manager.
Mr. M. Khan, learned counsel, appears on behalf of the claimants and is present along with claimant No. 1, namely, Dipanjali Ray.
It is submitted that the total awarded amount is Rs. 13,55,200/- (Rupees thirteen lakhs fifty five thousand two hundred) only, out of which an amount of
Page No.# 4/5 Rs. 13,15,000/- (Rupees thirteen thousand fifteen thousand) only has already been paid. After negotiation, both the parties have mutually agreed to settle the matter for an additional amount of Rs. 4,00,000/- (Rupees four lakhs) only as a full and final settlement of the claim.
Accordingly, the Oriental Insurance Company Limited is hereby directed to deposit the said additional amount of Rs. 4,00,000/- (Rupees four lakhs) only before the Registry of this Court within 1 (one) month from the date of the
order.
It is further noted that during the pendency of the present appeal, the claimant No. 4, namely, Praneshwar Ray, father of the deceased, has expired.
Consequently, out of the said additional amount of Rs. 4,00,000/- (Rupees four lakhs) only, an amount of Rs. 1,00,000/- (Rupees lakhs) only be deposited in the name of claimant No. 2 as fixed deposit in any nationalized bank till she attains the majority. The claimant No. 1, namely, Dipanjali Ray, wife of the deceased, shall be entitled to receive a sum of Rs. 2,30,000/- (Rupees two lakhs thirty thousand) only, and claimant No. 3, namely, Rine Bala Ray, mother of the deceased, shall be entitled to receive Rs. 70,000/- (Rupees seventy thousand) only.
Accordingly, the claimant No. 1, Dipanjali Ray, and claimant No. 3, Rine Bala Ray, are permitted to withdraw their respective shares of the amount, which will be deposited by the Insurance Company before the Registry of this Court, upon proper verification and identification.
