Present Ms. H. Malemleima, learned counsel for the petitioner and Mrs. N. Elizabeth, learned counsel for the respondents. [2]
It is submitted that in the mediation proceedings dated 05.11.2025, the parties have amicably settled the dispute and the present writ petition may be disposed of in terms of the settlement in the mediation proceedings dated 05.11.2025 and the same is reproduced below:
“SETTLEMENT AGREEMENT Imphal, 5th November, 2025
The present claim is for an assured amount of Rs. 30,00,000/- (Rupees Thirty Lakh only) under Insurance Policy Plan floated by HDFC Bank V12 HDFC Life Sanchay Fixed Maturity Plan under Policy No. 25063897. In order to amicably settle the matter the complainant, through its counsel sent a letter dated 16-10-2025 to the Respondent thereby making a proposal to the Respondent stating that she is agreeable to settle the matter if the Respondent agrees to pay the assured sum amount under the aforesaid Policy less the premium of Rs. 3,13,500/- (Rupees Three Lakh Thirteen Thousand Five Hundred only) paid to her on 31-05- 2023 to the claimant. Based on the said letter, accordingly the Respondent agrees to issue a cheque of Rs. 26,86,500/- (Rupees Twenty Six Lakh Eighty-Six Thousand Five Hundred only) in favour of the complainant after deducting the premium amount OINAM THOIB A MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.11.14 11:23:11 +05'30'
of Rs. 3,13,500/- (Rupees Three Lakh Thirteen Thousand Five Hundred only) already paid to the complainant in full and final settlement of the matter thereby giving a closure on the matter. In view of this compromise being made by the parties, the Respondent agrees to pay a sum of Rs. 26,86,500/- (Rupees Twenty Six Lakh Eighty-Six Thousand Five Hundred only) to the complainant by way of cheque in full and final settlement of the matter.” [3]
In terms of the mediation proceedings dated 05.11.2025, the W.P. (C) No. 642 of 2024 is disposed of. [4]
Any interim order is merged with the final order.
