Brief facts of the case are that, the Assistant General Manager, State Bank of lndI'a, Guntur main branch filed a report on 08.12.2O22 before the Additional Dl'rector General of police, CID, Mangalagiri alleging that Al to A5 played fraud and cheated the bank to a tune of Rs.2.62 Crores by availing financial facility for working capital, cash credit for its business Purposes and also cash credit limit sanctioned by RAMSECC and SARC, Guntur which was processed by the Guntur main branch and sanctioned by the zonal credit committee-ll on 19.07.2011 and further extended the credit II'mitS uP tO
15.04.2013. After availing the said cash and credit facl'lI-ties, Al to A5 diverted the amounts with an intention to cheat the bank and stopped the business activity. 4. On a perusal of the material on record goesto showthat the alleged incident had taken place in the year 2011. Even as per the contents of the FIR, the accusation against the accused is that there are procedural lapses I-n forwarding the loan applications to the authorities concerned. 3 grJ been attributed against A4. Because of the procedural lapses, the department has initiated disciplinary actI'On against the officials and suitable punishment was also given to them for their procedural lapses. Though the alleged incident is said to have taken place in the year 2011, present Crime was registered only in the year 2022 i.e., after delay of more than ll years. 5. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant anticipatory bail to petitioner/A4 on the following conditions. i) ln the event of arrest of petitioner/A4 in the aforesaid crime, he sr}aII be enlarged on bail on his executing personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the concerned Arresting Officer.
ii) Petitioner shall make hl®mself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any Person acquainted With the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer.
