Mr. Uddin has submitted that the criminal petition under Section 528, Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred against an Order dated 09.05.2022, passed by the Court of Principal Judge, Family Court, Dhubri in F.C. [Crl.] Case no. 10/2022, which was registered on the basis of an application filed by the respondent no. 2 as the petitioner under Section 125, CrPC. Mr. Uddin has submitted that in view of provisions contained in Section 19 of the Family Courts Act, 1984, more particularly, sub-section [4] thereof, the petitioner wants to withdraw the writ petition in order to avail appropriate remedy.
