1. This is the second bail application of the applicant. The first bail application of the applicant has been dismissed as withdrawn vide order dated 16.12.2024 passed in MCRC No. 7177/2024 while dismissing the first bail application the liberty was granted to the applicant to repeat the same after examination of the material prosecution witnesses.

Learned counsel for the applicant would submit that the applicant is in jail since 21.07.2024 and till date only four witnesses have been examined the victim has also been examined as PW-1. 2 01.12.2020 when he entered into an agreement and started his business. The victim is a major girl having love affair with the applicant and the applicant is still ready to marry with the victim yet the report has been lodged by her in which the applicant has been arrested. The final adjudication of the case will take its own time, therefore, he may be enlarged on bail.
3. On the other hand, learned counsel for the State opposes the second bail application.

Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material collected during investigation further considering the facts that the first bail application of the applicant has been dismissed as withdrawn vide order dated 16.12.2024 till that day the victim has already been examined and the examination of the witnesses are going on and the trial is in progress, I am not inclined to admit the second bail application of the applicant.
5. Accordingly, the second bail application of the applicant Rahul Kumar Gupta is rejected. Sd/-
