Junior Civil Judge, Srikakulam without conducting any enquiry on representation made by the 3rd respondent in a causal manner referred the representation to the 2nd respondent, without committing any offence by the 1st petitioner straight away registered the crime by the 2nd respondent and registering the Crime vide FIR No.200/19 Dated 19.09.2019 is as illegal, improper and arbitrary consequently by setting aside the Crime and declared as void and pass…” 2. Heard Smt.A.Padma, learned counsel for the writ petitioners and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that police completed investigation and laid charge sheet before the learned Additional Judicial Magistrate of First Class, Srikakulam vide C.C.No.994 of 2019 and the same is coming up for trial and further the petitioners obtained anticipatory bail as per the Orders passed by the Judge, Family Court-cum-III Additional District and Sessions Judge, Srikakulam vide Crl.M.P.No.342 of 2019. 4. Considering the above facts and circumstances, learned counsel for the petitioners sought permission to withdraw the writ petition with a liberty to file fresh application in accordance with law, for quashing of the charge sheet. 5. Permission is granted. 4 6. Accordingly, the writ petition is dismissed as withdrawn. There shall be no order as to costs.
