HANUMANTHA RAO VELLALACHERVU The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus to declare the delay and inaction on the part of the Respondent No.l in providing police aid protecting the Petitioners from the Respondents No.4 to 11 while carrying out the agriculture operations in the land extent Ac. 1-67 cents Sy.No.365/1A Paiki, Ac. 1-67 cents in Sy.No.365/IB and Ac. 1-67 cents in Sy.No.356/1C Paiki of Cudikal Village, Yemmiganur Mandal, Kurnool District as per the orders dated 07-08-2023 in I.A.No.603/2023 in O.S.No. 198/2023 on the file of the Junior Civil Judge, Yammiganur as arbitrary, illegal and violation of Article 14, 21 of the Constitution of India and consequently direct the Respondent No.1 to provide police protection to the Petitioners protecting the Petitioners from the Respondents No.4 to 11 while carrying out the agriculture operations in the land extent Ac. 1-67 cents Sy.No.365/1A Paiki, Ac. 1-67 cents in Sy.No.365/1B and Ac. 1-67 cents in Sy.No.356/1C Paiki of Gudikal Village, Yemmiganur Mandal, Kurnool District as per the orders dated 07-08-2023 in I.A.No.603/2023 in O.S.No. 198/2023 on the file of the Junior Civil Judge, Yammiganur in the interest of justice”. 2. Heard Sri P.Nagendra Reddy, learned counsel for the Petitioners and Sri V.Farooq, learned Assistant Government Pleader for Home. 3. The fact remains that, a civil suit in O.S.No.198 of 2023 is pending before the Court of Junior Civil Judge, Yemmiganur. It is also the fact that an ad-interim injunction was granted in favour of the Petitioners vide Orders 3 dated 07.08.2023 in I.A.No.603 of 2023 in O.S.No.198 of 2023 and the same has been extended from time to time. There is no dispute that, as the interim injunction is in favour of the Petitioners, they approached the Police to protect their property from the unlawful interference of the unofficial Respondents. 4. Considering the submissions made, the Writ Petition is disposed of directing the Police to look into the grievance of the Petitioner and take appropriate steps as per the governing rules and law. However, the parties are at liberty to recourse their remedy before the competent Civil Court. There shall be no order as to costs.
