Respondent(s) For Petitioner(s) : None For Respondent(s) : Mr. Prateek Tiwari, Panel Lawyer Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 23.06.2025 1) None for the petitioner even in two rounds. 2) It is submitted by Mr. Tiwari, learned State counsel that the order passed by the Commissioner, Durg Division, on 05.08.2021, directed the Digitally signed by NADIM MOHLE 2 petitioner to vacate the Government accommodation bearing House No. E-5. He would further submit that at the relevant time, the petitioner was posted as Additional Superintendent of Police at Kabirdham. Subsequently, the petitioner was transferred to Bijapur; however, the Government accommodation was not vacated despite the transfer order. Consequently, the impugned order was issued. He lastly submit that once the petitioner has been transferred, she had no right to retain the Government accommodation. 3) Taking into consideration the fact that the petitioner, who was posted as ASP at the relevant time has been transferred from Kabirdham to Bijapur, therefore, the order impugned directing her to vacate the Government accommodation has rightly been passed. 4) Since the services of the petitioner were transferred, she had no entitlement to continue occupying the said accommodation. Therefore, the order passed by the Commissioner, Durg Division, does not call for any interference. 5) Accordingly, the writ petition is hereby dismissed at the admission stage itself. 6) Interim relief, if any, granted earlier stands vacated.
