This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the inaction on the part of respondents 2 and 3 on petitioners representation dated 25-09-2020 submitted for granting police aid for cultivation of his land an extent of Ac.0.88 cents in Survey Number 63/2 of Pedapadu Revenue Village and Mandal of West Godavari District in pursuance of the Decree and Judgment in O.S.No.692 of 2001 passed on 03-05-2007 by

learned court of Principal Junior Civil Judge at Eluru, West Godavari District, as illegal, irregular, irrational and amounts to non discharge of legal obligation conferred on the part of 2nd respondent and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 2 and 3 to grant police aid to petitioner for cultivation of his said land.”

Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the Petitioner has sent a representation to the Superintendent of Police, West Godavari District and the same was forwarded to the concerned Police Station and in turn, the concerned Police Officer tried to contact the Petitioner over phone, but the Petitioner was not available and was at Hyderabad. For that reason, the Police have not responded to his request. Learned Asst.Government Pleader would further submit that, Crime No.235 of 2020 has been registered against the unofficial Respondent for the offences under Sections 447, 427 and 506 read with 34 IPC. 3.
Ms.Nimmagadda Revathi, learned counsel for the Petitioner would submit that, by virtue of a decree passed by a Civil Court in O.S.No.692 of 2001, dated 03.05.2007, permanent injunction is in favour of the Petitioner. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
