The present applicant is in judicial custody since 24.09.2024 in relation to Case Crime No. 213 of 2024 registered on the basis of First Information Report dated 01.05.2024, P.S. Gangnahar, District Haridwar, wherein, the present applicant along with his family members were also implicated for the offence punishable under Section 306 of IPC. 4. Learned counsel for the applicant submits that the deceased was the wife of the applicant, who married with the applicant 15 years back and from this marriage two child were born. 5. He submits that the allegations as alleged are totally false, which is evident from the fact that the marriage took place 15 years back and there was no any such allegation with regard to demand of dowry and; only on the basis that the applicant have some illicit relation with another lady the victim commit suicide. 6. Apart from this, learned counsel for the applicant submits that the chargesheet has already been filed therefore there is no need of custodial interrogation. 7. Learned A.G.A. Mr. Pankaj Joshi submits that after thorough investigation and after collecting credible evidence the chargesheet was filed; however, he has not disputed this fact that applicant married with the deceased 15 years back and from this marriage two children were born. 8. After hearing the learned counsel for the parties and further taking into consideration that the chargesheet has already been filed and therefore there is no need of custodial interrogation of the applicant; therefore, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 10. Let the applicant ‘Sonu’ be released on bail on furnishing his personal bond and two sureties of each of the like amount to the satisfaction of the court concerned.
