This bail application has been filed by the petitioner namely, Umesh Gour under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking regular bail in connection with Sessions Case No.154/2025 pending before the Court of learned Additional Sessions Judge (FTC) Sribhumi corresponding to Patharkandi P.S. Case
Page No.# 2/2 No.162/2025 under Section 87 of BNS, 2023.
3. The facts as revealed by the TCR appeared to be that the victim girl was a minor at the time of occurrence, has been in a love relation with the petitioner and had eloped with petitioner. Subsequently, she was recovered.
4. By now the Charge-sheet has been laid and the petitioner has been in detention for 124 days.
5. On considering the nature of allegations as well as the aforesaid facts, further detention of the petitioner is not considered necessary. Accordingly, the prayer for bail is allowed.
6. Accordingly, the petitioner, named above, shall be released on bail on furnishing a bond of Rs. 20,000/- with one surety of the like amount to the satisfaction of the learned Additional District & Sessions Judge (FTC), Sribhumi in connection with the aforementioned case.
7. The direction for bail is further subject to the conditions that the accused petitioner – (1) shall not hamper the investigation and tamper with the evidence of the case; and (2) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
8. In terms of the above, this bail application stands disposed of.
