By this application, the petitioner has prayed for pre-arrest bail in connection with RPF/POST/HMY/AT NLP Case No. 04/2025 registered under Page No.# 2/3 Section 3(a) of RP (UP) Act. 3. The instant case relates to stealing of some wires owned by the Railways and an enquiry was conducted and during the enquiry, notice was issued to the petitioner under Section 9(1)&(2) of the RP (UP) Act, 1966. 4. The learned counsel for the petitioner submits that the petitioner has been implicated in the instant case on the basis of the statement of the co-accused and he submits that the petitioner has no connection whatsoever with the offence in question. 5. Mr. K.K. Parashar, learned CGC for the respondent submits that the named accused persons, who were arrested in connection with the aforesaid case had confessed before the Enquiry Officer and had taken the name of the petitioner as one of the accused person involved in the offence. 6. On consideration of the submissions made by the learned counsels for the parties, moreso, on the fact that there are no other materials except the statement of the co-accused, this Court deems it fit to release the petitioner on pre-arrest bail on furnishing bail bond of Rs. 20,000/- with 1 local surety of like amount to the satisfaction of the arresting authority under the following conditions:- 1. The petitioner will appear before the Investigating Officer within 7 (seven) days from today and will co-operate with the investigation. 2. The petitioner will not temper with the evidence or influence any other witnesses connected with the instant case. 3. The petitioner will not leave the place of residence without the permission of the arresting authority. Page No.# 3/3 7. Accordingly, the Anticipatory Bail Application stands disposed of.
