Complainant who is respondent No.2 in both cases is present. Accused No.1 is present. Accused Nos.2 and 3 are absent. 2. Both learned counsel for both parties as well as learned HCGP present. - 4 -

3. These petitions are filed by accused Nos.1 to 3 under Section 482 of Cr.P.C, to quash the criminal proceedings in C.C.No.194/2018 for the offences punishable 498A, 323, 354 506 r/w Section 149 of I.P.C.
4. A compromise petition is filed in Crl.P.No.5502/2018 along with affidavits of respondent No.2/complainant in both cases. 5. The terms and conditions of settlement arrived at between the parties reads as under:
" The Petitioner No.1 and 2 and the Respondent No.2 begs to submit as under:
1. This Criminal Petition has been filed for quashing the entire proceedings in C.C.No.194/2018 on the file of II Additional Senior Civil Judge and J.M.F.C. at Mandya for an offence punishable under section, 498A, 323, 420 R/w 34 of IPC and Section 3 and 4 of Dowry Prohibition Act and the later on it is renumbered as C.C.No.589/2020 since the matter was transferred to 1st Additional Civil Judge and J.M.F.C. Mandya. - 5 -

2. The 1st Petitioner herein is the husband of the Respondent No.2. The 1st Petitioner had filed the M.C.No.4677/2016 on the file of V Additional Principal judge Family Court at Bangalore for Decree of Divorce dissolving the marriage between them. The above said matter has been settled between the petitioner Nol and the respondent No.2 on 20/12/2024 and they have united and residing together. In the above M.C.No.4677/2016, the respondent No.2 had undertaken to withdraw the criminal petition against the petitioners and also against his brother and mother. 3.
By virtue of the compromise entered between the Petitioner Nol and 2nd Respondent in M.C.No.4677/2016, the respondent had agreed to allow the present petition and quash the entire proceedings in C.C.No.194/2018 on the file of II Additional Senior Civil Judge and J.M.F.C. at Mandya for 354,506 an offence punishable under section, 498A, 323, 354, 506 R/w 34 of IPC and Section 3 and 4 of Dowry Prohibition Act and the said case is renumbered as C.C.No.589/2020 since the matter was transferred to 1st Additional Civil Judge and J.M.F.C. Mandya, therefore at this stage of the case it has become necessary to quash the proceedings under the New. C.C.No.589/2020 since the matter

was transferred to 1 Additional Civil Judge and J.M.F.C. Mandya. 4. The 2nd respondent withdraws all the allegations made against the petitioners. 5. The Petitioners and the respondent No2 file this Compromise petition without any undue influence, coercion and force and they have voluntarily entered into this Compromise and also agreed to the terms of this Compromise. 6. The Petitioners and the respondent No.2 have produced their respective aadhar card for kind perusal of this Honorable court. Wherefore the Petitioner No 1 and the respondent No2 most humbly prays that this Honorable court be pleased to allow the petition and quash the entire proceedings in C.C.No.589/2020 on the file 1st Additional Civil Judge and J.M.F.C. Mandya, for an offence punishable under section, 498A, 323, 354, 506 R/W 34 of IPC and Section 3 and 4 of Dowry Prohibition Act by taking in to
consideration of the settlement arrived between the parties in the interest of justice and equity".
6. Respondent No.2/complainant admit the compromise and submits that she has no objection to allow the petitions. The terms and conditions of

compromise petition are legal and equitable. The same is accepted and accordingly, following:
ORDER (i) The petitions filed under r/w Section 482 Cr.P.C, are allowed. (ii) The entire proceedings in C.C.No.194/2018 (Crime No.1/2018) on the file of II Additional Senior Civil Judge and JMFC., at Manday, is hereby quashed. (iii) The Registry is directed to send copy of this order to the trial Court forthwith.
