2025:JHHC:13653 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.6179 of 2024 ------ Jitendra Thakur, son of Devdatta Thakur, resident of Near Hut ST 556, Jhopri, P.O. & P.S. Dhurwa, District Ranchi, Jharkhand. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Sheo Kumar Singh, Advocate. For the State : Mr. Sunil Kumar Dubey, A.P.P. ----- 07/ 06.05.2025 Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences under Section 108/3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. The petitioner is the father of Binay Kumar. The allegation is that the son of the petitioner was having some relationship with the deceased. Later on, this petitioner and others refused to solemnize the marriage. It is alleged that the petitioner and his son used to verbally abuse the deceased, as a result of which she committed suicide. 5. After going through the record, I find that the allegation against the petitioner that he refused to get his son married with the deceased; the petitioner used to verbally abuse the deceased and this petitioner was not happy with the relationship between Binay Kumar and the deceased. 2025:JHHC:13653 2 6. Considering the nature of allegation, I am of the opinion that prima facie there is nothing to suggest that the petitioner has abated the deceased to commit suicide. The petitioner is aged about 74 years, as submitted by learned counsel representing the petitioner. Thus, I am inclined to enlarge this petitioner on anticipatory bail. 7. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned JMFC, Ranchi, in connection with Sadar P.S. Case No.310 of 2024, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
