This writ petition has been filed with the following prayer: "Issue a suitable order or direction in the nature of commanding/directing the Court, Respondent No.1, to decide the application dated 29.05.2017 (Paper No.63 Ga) and application dated 16.08.2023 (Paper No. 112 Ga) filed by the petitioner, in suit No. 274 of 2016 (Arthav Kaura Vs. Satish Kaura and others), within stipulated time, which this Hon'ble court may deem fit and proper in view of the facts and circumstances of the case." It is contended by learned counsel for the petitioner that in a suit instituted by the plaintiff-petitioner, an application for appointment of hand writing expert was moved on 29.05.2017 (Paper No.63Ga) and application dated 16.08.2023 (Paper No.112 Ga), which till date has not been decided by the court concerned. The sole prayer made in the writ petition is for expeditious disposal of the said applications. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Additional Civil Judge (Senior Division), Court no.10, Ghaziabad to decide application dated 29.05.2017 (Paper No.63 Ga) and application dated 16.08.2023 (Paper No. 112 Ga) filed by the petitioner, in suit No. 274 of 2016 (Arthav Kaura Vs. Satish Kaura and others), in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
