11.06.2025 Item No.56 Ct.No.34 rc. C.R.M. (M) 473 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Purbasthali Police Station Case No. 25 of 2021 dated 19.01.2021. And In Re : Ejarul Sk @ Rijaul Sk @ Rejaul Sk ... Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh ... for the Petitioner Ms. Amita Gaur Ms. Snigdha Saha ... For the State The petitioner is in custody for about 125 days and prays for bail. Learned counsel for the petitioner submits that the co- accused are on bail. The petitioner is not the principal assailant and no specific role has been attributed to him. Opposing the prayer, learned counsel for the State submits that the petitioner has been absconding for about four years and has surrendered before the learned Court only on February 07, 2025. I have considered the material on record. The petitioner has been absconding for considerable period of time. Considering the conduct of the petitioner as well as the 2 extent of his complicity in the alleged offence, prayer for bail is rejected at this stage. The bail application is disposed of. Case Diary is returned. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
