HC-KAR NC: 2025:KHC:18839 WP No. 12275 of 2025
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE M.NAGAPRASANNA
ORAL ORDER
The petitioner - plaintiff in O.S.No.662/2025 is at the doors of this Court calling in question the following order:
"ORDER ON I.A.NO.I
The plaintiff has filed I.A.No.I U/O.XXXIX Rules-1 and 2 r/w Sec.151 of CPC seeking to restrain the defendants, their agents or any persons acting on their behalf from sales, manufacturing and processing of chemical processing, painting, anodizing and related processes till disposal of the suit. Heard on application filed by the plaintiff. I have perused the materials available on record. At this juncture, this Court is not inclined to grant exparte interim order and before passing an ad- interim order, this Court feels that hearing the other side on the application is necessary. Hence, issue suit summons and emergent notice on I.A.No.I to the defendants."
2. The concerned Court passes an order on hearing the present petition of the plaintiff declining to grant an ex-parte order as sought for, but would consider it after hearing the defendant. - 4 -
HC-KAR NC: 2025:KHC:18839 WP No. 12275 of 2025
3. The learned counsel appearing for the petitioner submits that the defendants are carrying on with the business contrary to the non disclosure agreement signed by the defendants with the plaintiff, 10 days prior of his resignation which comes about on 10.03.2025. 4. Be that as it may. The learned counsel would also submit that the defendants have entered appearance today. 5.
In that light, I deem it appropriate to dispose the petition with a direction to the concerned Court to hear both the parties and pass necessary orders on the application so filed by the petitioner seeking injunction or restraint against the defendants therein, within four weeks from the date of receipt of copy of this order.
