1. Heard Mr. A.N. Ahmed, learned counsel for the petitioner and also heard Ms. P. Das, learned Addl. P.P for the State. 2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Shahidul Islam @ Saidul, who was arrested on
Page No.# 2/3 22.08.2025 in connection with Lakhipur P.S. Case No. 101/2025 under Sections 147/148/149 of BNS r/w Section 10/13/16/18(B)/20 UA (P) Act. 3. An FIR was lodged by the SI of Lakhipur Police Station stating that the United Liberation Front of Assam (Independent) [ULFA (I)] is actively engaged in large scale recruitment of cadres with the intent to perpetrate subversive and terrorist activities across Assam and the same are being facilitated by over- ground workers(OGWs) and linkmen. Acting on such input one Eyasin Ali was arrested. 4. The present petitioner is not named in the FIR but he has been arrested on the basis of interrogation of other arrested accused persons, which revealed the name of the present petitioner. The petitioner was shown arrested in the present case as he was already in custody in connection with another case where after he was interrogated in police custody. 5. It is noted in the case diary that it has come to light that the present petitioner is found involved in terror financing in collaboration with other accused persons. However, no such material is available in the case diary on the basis of which it is claimed that the accused is involved in such activities. 6. Therefore, I do not find sufficient material against the petitioner under any provision of the Unlawful Activities (Prevention) Act warranting invocation of Section 43(d)(5) of the said Act. 7. Further, in the absence of any other material, further detention of the petitioner in connection with the present case is not warranted. 8. Accordingly, the prayer for bail is allowed. 9.
It is provided that the accused petitioner, named above, shall be released on bail of
Page No.# 3/3 Rs.50,000/- (Rupees Fifty Thousand) with one surety of like amount to the satisfaction of learned Special Judge, Goalpara in connection with the instant case, if not wanted any other case. 10.
