Hon'ble Mrs. Manju Rani Chauhan,J. Learned counsel for the applicant submits that an Application U/S 482 No. 28106 of 2021 (Manish Agarwal and Another Vs. State of U.P. and Another) is pending wherein entire proceedings of Case No. 847 of 2020 has been challenged. He further submits that as a result of consequential proceedings before the trial court, order dated 06.02.2025 has been passed in the aforesaid case, which is under challenged in the instant petition along with further proceedings of the case. A preliminary objection has been raised by counsel for opposite party no.2 that during pendency of the earlier petition, the present petition will amount the second petition. On the aforesaid, learned counsel for the applicant submits that the instant petition may be dismissed as not pressed with liberty to the applicant to file amendment application in the earlier petition i.e. Application U/S 482 No. 28106 of 2021. In view of the statement given by learned counsel for the applicant, the instant petition is dismissed as not pressed with liberty to file amendment application in the earlier petition.
