THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE ANANT RAMANATH HEGDE ORAL ORDER 1. Heard the learned counsel appearing for the petitioner and Sri Sandesh S. Chowta, learned senior counsel appearing for respondents. 2. The petitioner is assailing the order dated 04.02.2022 passed by 5th respondent Additional General Manager (IS/CO), M/s Bharat Electronics Limited (BEL) and also sought a direction to 4th respondent Company to comply the Official Memorandum dated 14.10.2013. 3. Learned counsel for the petitioner submits that a disciplinary enquiry is initiated without any basis and - 4 - HC-KAR NC: 2025:KHC:19804 WP No. 12336 of 2022 without giving opportunity to the petitioner to lead evidence. Enquiry is concluded by violating the procedure and proposal for petitioner's dismissal is placed before the Central Government Industrial Tribunal (CGIT). 4. It is his further submission that petitioner has also filed an application before the (CGIT) on the premise that application seeking approval for dismissal is not maintainable for want of authority and jurisdiction. He further submits that the application is not yet considered on its merit and under these circumstances, petitioner has filed the present writ petition. 5. Learned counsel for the respondent on the other hand would submit that the petitioner has to raise his grievance before the CGIT and the CGIT has to pass appropriate orders based on the materials placed before it. 6. Since the CGIT is now functioning, this Court is of the view that CGIT is to be requested to dispose of pending applications as expeditiously as possible. - 5 - HC-KAR NC: 2025:KHC:19804 WP No. 12336 of 2022 7. It is also made clear that both parties are permitted to produce additional pleadings and additional material if required in support of their pending applications. 8. Both parties are permitted to raise all permissible pleas available under law. 9. It is made clear that this Court has not expressed any opinion on either of the parties. 10. Writ petition is disposed of with the above observations. 11. In view of disposal of the petition, interim applications if any do not survey for consideration.
