Bhagat Ram vs. State of Himachal Pradesh and others CWP No. 10975 of 2023 03.06.2025 Present Ms. Babita Chauhan, Advocate, for the petitioner. Mr. Rajan Kahol and Mr. Vishal Panwar, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General, for the respondents/State. While placing on record copy of office order dated 02.06.2025, issued under the signatures of Engineer-in-Chief, HPPWD, Shimla, Mr. Vishal Panwar, learned Additional Advocate General states that relief prayed for in the instant petition has been granted to the petitioner and as such, nothing remains to be adjudicated in the instant proceedings. Careful perusal of aforesaid Office order reveals that petitioner herein has been granted work charge status w.e.f. 01.01.2005 on completion of eight years continuous service on notional basis in accordance with the directions of Hon’ble Apex Court in Surajmani case. The Superintending Engineer & Executive Engineer have been further directed to take necessary steps for extending the benefit accordingly. In view of the above, though this Court is persuaded to agree with learned Additional Advocate General that nothing remains to be adjudicated in the instant proceedings, but this Court cannot lose sight of the fact that on account of grant of work charge status, pay fixation is to be done. Learned Additional Advocate General states that pay fixation, if not already done, shall be done expeditiously. Consequently, in view of above, the present proceedings are closed with a direction to the respondents to ensure that pay fixation on account of conferment of work charge status upon the petitioner w.e.f.01.01.2005 is done expeditiously, preferably within a period of four weeks. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate Court of law qua the surviving grievance, if any. (Sandeep Sharma) Judge June 03, 2025 (shankar)
