For the Respondents: Mr. Anup Rattan, Advocate General with Mr. Vishal Panwar and Mr. B.C.Verma, Additional Advocate Generals and Mr. Ravi Chauhan, Deputy Advocate General, for the respondents-State. ____________________________________________________ Sandeep Sharma, Judge(oral): Petitioner herein, who at present is working as TGT(Non- Medical) at Government High School, Kanda u/c Government Senior Secondary School Halau, Education Block Nerwa, District Shimla, Himachal Pradesh, has approached this Court in the instant proceedings seeking direction to the respondents to consider and decide her representation dated 10.06.2025 (Annexure P-1), whereby prayer has been made on behalf of the petitioner for her transfer from afore station to one of the stations of her choice, as 1Whether the reporters of the local papers may be allowed to see the judgment? 2 detailed in the representation, on the ground of adverse family circumstances. 2. Having regard to the nature of prayer and order proposed to be passed, this Court sees no necessity to call for reply on behalf of the respondents, who are otherwise represented by Mr. Ravi Chauhan, learned Deputy Advocate General. Learned Deputy Advocate General states that mere completion of normal tenure of posting at one station may not be a ground to seek transfer, rather it is the sole prerogative of the employer to post an employee at a particular station. 3. Since it is quite apparent from the pleadings adduced on record by the petitioner that she has been working at present place of posting for more than three years, coupled with the fact that transfer policy formulated by the Government of Himachal Pradesh provides for minimum tenure of three years at one station, this Court sees no impediment in issuing direction to the respondents to consider and decide the her representation expeditiously, preferably within a period of three weeks. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass appropriate order, taking note transfer policy, which enables an employee to seek transfer on account of adverse family circumstances. 3 4. Since stations indicated in the representation is stated to have been filled up, petitioner would be at liberty to file fresh representation on the date of hearing given by the authority concerned in terms of instant order, enabling competent authority to do the needful.
